Copyright Law and Youtube

The topic about the shift of copyright law during class on Monday really intrigued me. Often on Youtube, there are many channels who post copies of television shows, movies, and music without the consent of the producer. There are a few ways to attempt to get around the copyright law, which are changing the tempo or pitch, or creating multiple users and uploading the content every time one gets taken down. There are many more content creators than there are aggregators. By doing so, they are creating an endless cycle between the producers of the infringed copyright media and Youtube.

I was inspired to look up more about the Youtube Copyright Law and how they catch illegal use in videos on their website. According to Videomaker.com: “In May 2008, Viacom brought a $1 billion lawsuit against YouTube for allegedly failing to protect the rights of copyright owners. ” By allowing users to get away with this crime, the producers of the content have lost millions of dollars in royalties. By losing so much money, the producers began to target Youtube to change their policy and do something about the copyright issues. Because of this issue, Youtube now has a scanning device that scans each video published on the website for copyrighted material, and will pull the video if it senses any infringement.

According to Youtube.com, Fair Use is a way to avoid copyright infringement. Fair use is a legal way of using material under certain circumstances without having to get permission from the copyright media owner. Here are the circumstances according to Youtube:

“1. The purpose and character of the use, including whether such use is of commercial nature or is for nonprofit educational purposes

2. The nature of the copyrighted work

3. The amount and substantiality of the portion used in relation to the copyrighted work as a whole

4. The effect of the use upon the potential market for, or value of, the copyrighted work”

Overall, the safest way to avoid copyright infringement is to get written consent from the producers of the media.
